Brothers and Sisters, we are poised to see labor law reform in 2009 but we must keep the pressure on at home!  We are headed into another Congressional Recess with unprecedented grass roots activity planned calling for passage of the Employee Free Choice Act.  Next week we need to make sure Senator Bayh can see, hear, and feel our presence around the state.  That means phone calls, emails, faxes, attending events, and writing letters to the editor of your local papers are incredibly important.  We need to let Senator Bayh know that Indiana is counting on him to help restore the middle class and worker's rights.


Employee Free Choice Act – Fact vs. Fiction

FICTION: Employee Free Choice eliminates the secret ballot and replaces it with majority sign-up. This process will expose workers to coercion by their co-workers and union representatives to support the union.

   

FACT: Employee Free Choice does not remove the National Labor Relations Board (NLRB) election process; it gives employees a choice between an election and majority sign-up. Currently, the boss decides which process workers will use. By choosing an NLRB election, managers give themselves the opportunity to coerce employees into voting against union representation. When an employer is faced with a union organizing drive:

  • 30% fire pro-union workers;
     

  • 49% threaten to close a worksite when workers try to form a union, but only 2% actually do;
     

  • 51% coerce workers into opposing unions with bribery or favoritism;
     

  • 82% hire high-priced union busting consultants to fight union organizing drives; and
     

  • 91% force employees to attend one-on-one anti-union meetings with their supervisors.¹

 
 
   

FICTION: The current law adequately protects workers from employer coercion by imposing penalties on companies caught illegally intimidating workers who want union representation.

   
FACT: Current penalties for employers who break the law are minimal. Often managers find violating the law to be cheaper for the bottom line than negotiating a union contract with fair wages and benefits.
